Terms & Conditions

Reservations

Reservations made online guarantee the vehicle for up to 2 hours after your reserved pick-up time. After that the reservation is deemed expired and we may or may not be able to accommodate you with the vehicle, depending on availability.

Extensions

If the customer decides to extend the rental, an additional authorization will be taken to cover extra days. Contracts without prior authorization for extension will not be extended. For contract extension to be valid customer must electronically sign the updated contract. If the vehicle is overdue, and the customer is unreachable after three days of us attempting to reach the customer via email and phone calls, or if the customer is unable to provide a valid payment method, the vehicle must be return to our location within 24 hours or the vehicle will be located/repossessed. If we are unable to repossess the car, the vehicle will be reported stolen.

Prepaid Reservation Modification

A prepaid reservation can be changed up to 24 hours before the start of the rental only if reserved directly on www.drivo.com (subject to availability). Any payment already made towards the rental will not be refunded; nor shall any differential amount be refunded if this modification leads to a lesser rental cost. Any changes made to a prepaid reservation may impact the rate.

Cancellation

A prepaid booking can be cancelled before the start of the rental. In the event of cancellation, any refund of the payment made towards the rental is subject to a cancellation fee. The cancellation fee will never exceed the total prepaid amount.

- Cancellations up to 24 hours prior to scheduled pick up time will result in the collection of 30% of the total price as a cancellation fee. The remaining prepaid amount in excess of 30% of the total price will be refunded.

- Cancellations within to 24 hours prior to scheduled pick up time will result in the collection of 50% of the total price as a cancellation fee. The remaining prepaid amount in excess of 50% of the total price will be refunded.

- No refund will be issued in case of cancellation after scheduled pick up time.

Supplemental Liability Insurance (SLI)

If purchased, Supplemental Liability Insurance (SLI) protects the renter against claims made by a third party for bodily injury and/or property damages sustained as a result of an accident while the renter is operating a rental vehicle.

This SLI provides the renter with third-party liability protection up to a limit of USD 100,000 per accident.

SLI does not cover all situations that may arise while operating a rental vehicle. SLI does not cover all risks.

SLI is subject to exclusions for unauthorized or intoxicated drivers. Other exclusions may apply. Police report is necessary for SLI to be valid.

Supplemental Deductible Coverage (SDC)

The Supplemental Deductible Coverage covers up to $1000 of customer’s personal insurance deductible. The customer will be held liable for any damage or loss exceeding the amount $1000.

Personal Accident Coverage (PAC) /Personal Effects Coverage (PEI)

Personal Accident Coverage provides limited coverage bodily injury to occupants of the rental vehicle. Personal Accident Coverage does not cover all risks. For further details please see or PAC/PEI brochure and find the full PAC/PEI policy available for your review upon request.

Personal Effects Coverage provides limited coverage for your personal belongings from loss or damage caused by theft, damage, or accident to your rental car. Personal Accident Coverage does not cover all risks. Personal Effects Coverage provides reimbursement for the actual cash value of most items subject to certain maximums, deductibles, limitations, and exclusions. Age Restrictions

The minimum age to rent a vehicle in the state of New Jersey location is 21, in the state of New York 18 and the driver must have a valid driver’s license. Underage drivers are restricted to ECAR, CCAR and ICAR only. For larger-sized vehicles and specialty vehicles the minimum age of 25 years applies. Maximum age to rent a car is 80 years.

 

An Underage Driver Fee of $79.99 per day will apply for drivers 18-20

An Underage Driver Fee of $25.00 per day will apply for drivers 21-24

Additional Requirements

Drivo reserves the right to decline a rental where the renter’s driver’s license restricts the operation of the requested rental vehicle.

Maximum duration of a rental contract is 30 days. A rental day shall consist of each consecutive 24-hour periods beginning after the start of the rental.

A valid phone number and email address is required to rent a vehicle.

A credit check will be performed to determine the eligibility to rent a car at the time of the rental. Customers must meet the minimum criteria to rent. Customer who fail to meet the minimum criteria will be refused a rental.

Payment Information

In General

We accept most major credit and debit cards including American Express, Visa, Discover, Mastercard. All credit/debit cards need to be issued by a major financial institution that offers physical banking locations. The means of payment, which must be valid and presented at the start of the rental, must be issued under the renter’s name.

An authorization of up to $500 will be taken in addition to the rental amount due to secure the rental. We do not accept Cash, Prepaid cards, MCU cards, Checks, Money Orders, Electronic Use only cards, Visa Electron cards, credit/debit cards from domestic online banking institutions.

Debit cards are not accepted for local renters at airport locations. Debit cards with available funds may be accepted at select locations at our sole discretion with two forms of government issued ID, and only if one of the following conditions are met.

1. The renter presents a return airline ticket or roundtrip itinerary upon pick-up made at least 24 hours prior to the pick-up date, that coincides with the drop-off date and location. The return flight date cannot be before the vehicle return date, and the return flight city cannot be outside of the immediate area of the vehicle return city. Non-local domestic renters with a debit card cannot rent any Full-sized or Over-sized SUVs, Premium, Luxury, Extraordinary or Specialty vehicles, with the exception of Minivans. Customers travelling internationally, whose debit car is issued in their country of origin may rent any category vehicle except for Specialty Cars. OR

 

2. A local renter at downtown location can present an original and current utility bill which matches the name and address on the Driver’s License of the renter. Photocopies, printouts, digital images (digital format can be accepted provided that the source of the document comes from the official page) are not permitted. Utility bills need to be the most current or from the last 30 days and cannot be Past Due. Local renters with a debit car may need additional documentation and can only rent Vans, Economy through Full-size sedans, Compact through Intermediate SUVs.

The amount that will be authorized includes the rental price as well as additional charges and extras. The funds will not be available to you until after the vehicle has been returned. Some vehicles have a higher authorization or deposit amount and may require the use of a credit card.

The rental location may also perform a credit check or require additional qualifications in accordance with the local policy to determine whether the renter qualifies for a rental. The customer must meet the minimum criteria as determined by that location to qualify for a rental.

Collision Damage Waiver (CDW) with minimum deductible

The Collision Damage Waiver with minimum deductible reduces the renter’s responsibility to a part of the vehicle in event of damage to the rental vehicle. If Collision Damage Waiver with minimum deductible is accepted the renter is responsible for a following deductible: $0.00 for any vehicle rented from the car category. Collision Damage Waiver with minimum deductible does not cover all situations that may arise while operating a rental vehicle. Collision Damage Waiver with minimum deductible does not cover all risks.

Police report is necessary for the Collision Damage Waiver with minimum deductible to be valid. The Collision Damage Waiver with minimum deductible will be voided for unauthorized drivers, intoxicated drivers, if the terms and conditions of rental contract are violated, police report is not obtained, and/or in the events of negligence by the renter, while driving or in possession of the rental vehicle, such as, but not limited to, driving across beaches, rivers etc., driving under the influence of alcohol or drugs or any other substances that could impair the driver’s ability to operate the vehicle. Other acts of negligence include, but not limited to, leaving the keys in the ignition while the vehicle is unattended, falling asleep while driving, ignoring traffic signals or police officers.

The Collision Damage Waiver with minimum deductible does not cover theft. The protection by the Collision Damage Waiver with deductible is optional, as long as the renter has a valid insurance coverage that covers the rental vehicle, subject to regulatory and legal requirements. We will request a proof of your comprehensive insurance coverage information (declaration page). Failure to provide a proof of your insurance, when our insurance is declined, may be subject to denial of rental.

Prepaid Reservations

By booking a prepaid rate, the payment will be charged before the start of the rental with the estimated total amount of the rental (rental rate plus any applicable taxes and fees and other agreed charges). The driver and confirmed method of payment shall be finalized at the time of the reservation and cannot be changed. The confirmed method of payment must be valid and presented at the time of the rental and is subject to the conditions of payment above. All extra costs that occur during the rental will be charged to this payment method. Prepaid reservations are held until the end of the business day. A change from a prepaid rate to a nonprepaid rate is not possible.

No refund will be issued in case of failure to pick up your vehicle.

No refunds or credits will be issued for unused rental days once the vehicle is rented.

Extras

One Way Rental

If you have a one-way reservation the vehicle may be returned to one of participating locations only. Additional one time Drop Fee will apply.

- Newark Liberty International Airport Location (EWR) – 430 Route 1&9 South, Newark, NJ 07114

- John F. Kennedy International Airport location (JFK) – 124-10 S Conduit Ave, South Ozone Park, NY 11420

- LaGuardia Airport (LGA) – 2261 94th street, East Elmhurst, NY 11369

- Brooklyn Coney Island Location (BRK) – 3221 Coney Island Ave, Brooklyn, NY 11235

The vehicle may not be dropped off at any other location. Towing charge of $5 per mile plus towing fee, possible impound/storage fees will apply.

GPS

Navigations systems (portable or built-in) can be rented for $9.99 per day, based on availability

Additional Driver

A fee applies for the additional driver, whose details are noted in the rental agreement only if the additional driver presents a valid driver’s license. Only authorized additional drivers are allowed to driver the vehicles.

Additional driver fee is $9.99 per day per additional driver.

In New York the additional driver fee is $5.00 per day per additional driver

Infant, Toddler, and Booster Seats

Infant seats, toddler seats and booster seats can be rented for $9.99 per day per seat, based on availability.

Toll Services

  • Unpaid Tolls: If unpaid tolls are incurred with the rental vehicle, a daily EZ-Pass Service Fee of $6.95 is charged, plus the toll costs at the highest rate. The maximum service fee is capped at $34.75, excluding the toll expenses.

  • Payment Options:
    - Cash payments are accepted on toll roads that offer this option.
    - If cash is not accepted, the EZ-Pass Transponder Service is automatically used, incurring a $6.95 daily charge up to $34.75, plus the cost of tolls.
    - Renters may use their own EZ-PASS transponders.

  • Unlimited Toll Plan: An alternative is the $25.00 per day unlimited toll plan, ideal for extensive travel through toll areas, offering ease and potential savings.

Refueling options

The vehicles will typically be picked up with a full tank of fuel. If the tank is not full at pick up, the fuel level will be recorded, and the renter can return the car with the same level of fuel without incurring additional fees.

We offer a few fueling options:

- Prepaid Fuel. You may purchase the full tank of fuel at the time of rental. The price quoted at rental will lock in your fuel price at a competitive price with local fuel stations. If you purchase the fuel up front, do not refuel. No refunds will be given for unused fuel.

- If you do not purchase the Prepaid fuel and return the vehicle with less fuel than when rented, you will pay us for the fuel used at the price per gallon stated on your rental agreement.

- If you do not purchase the Prepaid fuel and return the tank full or at the same level when rented, there will be no charges for fuel.

Roadside Assistance Protection

We or the qualified 3rd party vendor will provide any renter who has purchased the optional Roadside Assistance Protection coverage with 24/7 breakdown assistance (where available) without any additional charge. Roadside Assistance Protection covers the renter against high service and repair costs for the following incidents:

- Emergency Towing: The covered vehicle will be towed to the nearest qualified service provider up to 100 miles of free towing. Charges are based on a per mile rating that vary from state to state

- Battery Assistance: We or the qualified 3rd party vendor will jumpstart the battery or minor emergency mechanical adjustments may be applied while on the road.

- Flat Tire Assistance: We or the qualified 3rd party vendor will install the inflated spare. If there is no spare or if the spare is flat, we or the qualified 3rd party vendor will tow the vehicle to the nearest qualified provider. No benefit is available for the cost of the tire repair or the second service call to return the repaired tire to the disabled vehicle.

- Fuel and Water Delivery Service: An emergency supply of fuel or water will be delivered to the covered vehicle. You only pay for the cost of liquids, parts or materials delivered.

- Winching: We or the qualified 3rd party vendor will extricate the covered vehicle from a ditch, snow, mud, or sand. Vehicle must be within 100 feet of state-maintained road. This benefit cannot be used for everyday normal snow removal. Maximum benefit is $100 per incident.

- Lost Key or Lockout Service: Locksmith service provided when keys are lost, broken or accidental locked in the vehicle. Benefit is limited to $100 per incident and the cost of the replacement keys is not covered.

All services may only be ordered by a direct claim with our 24-hour Roadside Assistance Protection by calling 1-855-866-3161. We will determine the type and the extent of service required to ensure the renter stays mobile. If any damage to the rental vehicle occurs which is not covered by us within the scope of the Roadside Assistance Protection, the renter is liable for such damage.

Liability Protection

Drivo does not extend any of its motor vehicle financial responsibility and Drivo does not provide any liability insurance coverage to renter, passengers or third parties through this reservation unless Drivo is obligated to do so due to legal requirements or according to the rental agreement.

The purchase of Supplemental Liability Insurance (SLI) is not required as a condition of renting a car. The renter’s personal insurance policy may provide the coverage for liability while operating a rental vehicle as per its terms and conditions. It is recommended that renters check the terms and conditions of their personal auto insurance policy to determine if coverage is provided for this rental. We will request a proof of your comprehensive insurance coverage information (declaration page). Failure to provide a proof of your insurance, when our insurance is declined, may be subject to denial of rental.

Driver’s License Requirements.

The renter and all authorized drivers must present a valid, unexpired, and original driver’s license at the time of the rental. The driver’s license must be in good condition and valid for the entire rental period. Temporary licenses are only accepted when presented alongside the original expired or voided driver’s license. Photocopies, digital licenses, Leaner’s Permits, driver’s licenses with restrictions, damaged or broken driver’s licenses, which we are unable to scan and verify are not accepted. All drivers with a non-US driver’s license must produce a valid passport at the time of the rental.

You are responsible for complying with all licensing and traffic laws and regulations. For vehicle groups FVAR (12 passenger vans) and PVAR (15 passenger vans): please check the local state laws for minimum Driver’s License Requirements. These vehicles may not be operated in Canada

Driver’s License printed with non-Roman Alphabet (Arabic, Chinese, Japanese etc.) must be complemented by an international driver’s license.

Customers travelling internationally will need to provide a proof of their tickets or boarding passes to qualify for the rentals.

Other Charges & Taxes

Recovery Fees

The recovery fees reimburse us for all, or portion of our expenses related to overhead costs at certain locations. These fees include the following: Airport Concession Recovery Fee / Privilege Fee Recovery Charge. Your quoted online rate will show applicable fees in detail on your reservation.

Customer and Rental Facility Charge

This charge is imposed by the airport authority on all rental car users on either a per transaction or per day basis. These funds are typically held in trust to pay for the financing of the building, transportation system, or operations and maintenance of the facility, as determined by the airport authority.

Transportation and Facility Fees

These third-party fees are intended to compensate for joint services and uses of Transportation and Facility Management between all rental car companies on site pursuant to Concession and Lease Requirements.

Vehicle Licensed Fee

This fee is used to cover the costs that we must pay for vehicle registration, license fees and related fees for a rental. It varies depending on the location.

Domestic Security Fee

This fee is imposed on motor vehicle rental companies in New Jersey for each day or part of a day that a motor vehicle is rented. It is assessed at the rate of $5 per day for all motor vehicle rental companies doing business in this State.

Other Fees

Those fees can either be mandatory or permitted, depending on the applicable law. Those fees vary by location. More information about those fees can be provided at the counter.

Taxes

All prices indicated in the rental information are net prices. State, federal, and local taxes apply to all rentals and charges.

Rewards

1. Membership Qualifications

Membership in Drivo Rewards Program (“Program”), operated by Drivo Rent a Car is available to individuals (not to corporations, businesses or other entities) who are at least twenty-one (21) years old, where Membership in the Program is not otherwise prohibited by law, that complete the following methods to enroll as an Drivo Rewards member (“Member”).

- Over the Web: Visit the Drivo Rent-A-Car Website (“Drivo Website”), click “Login” link, then click “Sign Up” link and complete account creation form. By creating an account, a Member accepts the Terms and Conditions, which are available on Drivo Website. If the Member already has an account, that member will automatically be enrolled in the Program at no cost to the Member.

Members must provide their full name, address, and date of birth to participate in the Program. Full name is defined as the given name (First Name), and surname (Last Name). The Member’s full name must be identical to the full name on the Member’s driver’s license.

No payment is required to become a Member.

By participating as a Member in the Program, you are agreeing to be bound by these Terms and Conditions.

Members may not maintain more than one Drivo Rewards account. Only one individual may be enrolled per Drivo Rewards account. In the event more than one Rewards ID is assigned to the same individual in breach of these Terms and Conditions, the duplicate account will be terminated, and the Drivo Rewards Points may be transferred to the remaining account.

Generally, membership in the Program (“Membership”) commences on the date the Member completes the enrollment method (“Enrollment Date”) or on the date the Program is established, whichever comes later, and remains in effect until the Member terminates enrollment in the Program (which can be done at any time) unless Drivo terminates a Membership earlier.

2. Member Account & Activity Information

Members may log in to a Drivo Website at any time to view and manager their account activity, account balance, and profile information by Signing In and linking to the “Profile” page.

Members must activate their account to access their Drivo Rewards Points by confirming their email address and creating a password for the account online. This is done online as part of the online account creating process.

3. Rewards ID

Members will receive a Drivo Rewards ID (“Rewards ID”) upon successful enrollment, which is personal to the Member and may not be used for rentals by any individual or entity other than the Member. The Rewards ID must be applied to all rental activity for it to be tracked toward program benefits and awards described herein.

4. Member Communications

By participating in the Program, Members agree to communicate with Drivo using electronic means, unless you are contacting us to exercise a legal right (in which case you can use any valid method of communication). Members are required to keep the electronic mail address provided to Drivo up-to-date. For this purpose, Members can update their electronic mail address on the " Profile" page on a Drivo Website. Electronic communications may be delivered to the last electronic mail address on file with Drivo. All communications in electronic format will be considered to be "in writing" and to have been received no later than five (5) business days after dissemination. Drivo reserves the right to provide communications in paper format, using the Member's most recent address on file with Drivo. Members expressly agree that any notice due under the Program, including any notices required by applicable law as a result of Member participating in the Program, may be given in email form to the email address provided by the Member and on file with Drivo. Without limiting anything contained herein, Member expressly agrees that it is the Member's sole responsibility to keep Member’s email address current and up-to-date and that Member may reasonably assume that any email sent by Member to the email address on file will be received by the Member. Regardless of any language contained in any email, consent to receive program and transactional communications electronically will continue to be valid until the Member revokes consent by terminating Membership in the Program except that Members may choose at any time to opt-in and opt-out of receiving electronic communications that contain marketing messages.

5. Qualifying Rentals and Rental Days

“Qualifying Rentals” must be a Drivo Rent-A-Car brand rental at participating locations in New York and New Jersey during which the member has paid time and mileage (base) or qualifying ancillary charges for one or more rental days.

“Qualifying Rental Days” are paid rental days associated with Qualifying Rentals.

Qualifying Rentals and Qualifying Rental Days do not include the following types of rentals:
a. Rentals when an insurance, dealer, body shop or fleet replacement rate is applied, regardless of who pays for the rental.
b. Rentals that were booked through a third party, including (but not limited to) third-party online travel agents (OTAs)
c. Rentals of exotic and luxury cars at Drivo Rent-A-Car
d. Discounted rentals by employees of Drivo-Rent-A-Car, and any of its parent company, subsidiaries, affiliates, licensees, and licensee employees who are eligible to receive an employee discount.

6. Drivo Rewards Points

Members will earn one (1) point for every qualifying U.S. dollar ("USD") spent on a Qualifying Rental with a rental return date after the Enrollment Date.

"Qualifying U.S. Dollars Spent" is defined as time and mileage (base) rate, paid upgrades, less any discounts or credits; and excludes all applicable taxes and surcharges, vehicle license fees, airport-related fees, insurance costs, fuel purchase option, and refueling. Points will be rounded up to the nearest USD.

Points will not be earned for Qualifying Rentals tied to corporate IDs for corporate accounts that do not allow employees to earn currency associated with reward programs.

When a Member earns one (1) or more points for a Qualifying Rental, Drivo will keep their points balance intact for the next twelve (12) months. Thereafter, the points balance will be forfeited.

7. Discounts; Restrictions

Members may redeem Drivo Rewards Points for discounts for their bookings in increments of twenty (20) dollars USD up to one hundred (100) dollars USD on eligible Drivo Rent-A-Car rentals on New York and New Jersey booked in advance on Drivo Website. Drivo Rewards Points may not be redeemed on: (a) Rentals when an insurance, dealer, body shop or fleet replacement rate is applied, regardless of who pays for the rental; (b) rentals that were booked through a third party, including (but not limited to) third-party online travel agents (OTAs); (c) Rentals of exotic and luxury cars at Drivo Rent-A-Car (d) Discounted rentals by employees of Drivo-Rent-A-Car, and any of its parent company, subsidiaries, affiliates, licensees, and licensee employees who are eligible to receive an employee discount.

Drivo Rewards Points may not be redeemed for rentals booked through phone bookings, Drivo branch locations, travel agencies or any other booking channels other than an Drivo Website.

Drivo Rewards Points discounts apply to time and mileage (base) rate only. Points are non-transferable. Use of discounts does not exclude Members from (i) extra hourly or Geo-Fence Violation charges; (ii) taxes, assessments, use fees or other governmentally imposed, authorized or permitted surcharges or pass-throughs; (iii) license recoupment fees, airport fees and concession recoupment fees; (iv) service charges and fees; (v) vehicle license recovery fees; and (vi) damage waiver, the cost of optional insurance products, fuel charges, optional upgrades, underage driver's fees, infant seats or other optional items. Payment for each of these items shall be the sole responsibility of the Member.

The value of points is as follows:
- 200 points = $20 discounts
- 400 points = $40 discounts
- 600 points = $60 discounts
- 800 points = $80 discounts
- 1000 points = $100 discounts

Members may determine how many points are required to redeem for each Award by visiting an Drivo Website, signing in as a Member, entering rental location, rental pickup and return dates and times, selecting the vehicle class, then selecting the Redeem Points drop down on the reservation confirmation screen.

Points will automatically be deducted from a Member's account upon successful completion of a redemption request/reservation.

At any time prior to rental pickup date, Members may choose to cancel the redemption rental reservation on a Drivo Website. For cancellations prior to the rental pickup date, points will automatically be re-deposited into the Member's account.

For redemption rentals that were not picked up prior to the rental pickup date (a "No-Show") or redemption rentals that were dropped off before the scheduled return date (an “Early Drop Off”), points will not be automatically refunded. In such cases member shall forfeit their points and waive and release Drivo from any claim or right in connection with such forfeiture.

8. Additional Program Terms and Conditions

Membership may be terminated by Drivo for any reason at any time with written notice unless such Membership would be prohibited by law which requires immediate termination/inactivation (without notice). The Member's right to terminate for convenience remains unaffected. Termination of a Membership is effective upon providing notice to the terminated Member using the methods described herein.

The Terms and Conditions of the Program may change and evolve over time. If Drivo changes these Terms and Conditions, Drivo will notify Member thirty (30) days before that modification comes into effect, and, if applicable, the Member will have the opportunity to use any accrued benefits or to terminate their Membership within that 30-day period, subject to any applicable laws. The Program is void where prohibited or restricted by law.

If you attempt to use or earn Points or Redeem Discounts in a fraudulent way, we may (in our sole and absolute discretion): (a) take away all Points in your Drivo Rewards membership; and/or (b) terminate your Drivo Rewards Membership. The Program is intended to benefit individuals rather than companies. Members may use Points for any personal or business purposes they choose. For purposes of administrating the Program, it is considered fraudulent and abusive for Members to use a single Drivo Rewards Account for the purpose of accumulating points for company use. It is a violation of these Terms and Conditions for a Member to share their Rewards ID with anyone for the purposes of earning or redeeming points on rentals or to complete the rental in the Member’s name without the Member being present.

The Program is a loyalty rewards program. Any rewards or other accrued benefits earned hereunder, including Drivo Rewards Points do not constitute property of a Member and cannot be redeemed for cash or other monetary value.

Territorial Restrictions & Rentals Across State Lines (Geo Fence Policy)

In General

The rental vehicle may only be used in the state of pick-up and the surrounding geographical area as specified in the table below:

Rental vehicles may not be driven to Mexico.

Geo Fence Violations

Unlimited mileage is only applicable within states listed in the Allowed-Zone. Geo-Zone violation fee is based on the rented car class and the territory the vehicle is driven to and is outlined in the table below. Geo-Zone violation fee will be applied from the first day of signing the contract until the vehicle is returned. Geo-Zone violation fee is reduced in the states listed in the Discounted and Permitted Zones, and will be charged in full in any state not listed in the table above. If the vehicle is driven outside of the Allowed-Zone and Permitted-Zone, the CDW coverage purchased at the counter will be voided and customer will be responsible for possible breakdowns. Vehicles may not be driven to the Prohibited Zone. Violators will be charged Geo-Zone violation fee, the CDW will be voided, and the car will be immediately placed for repossession and reported stolen to the police.
